Learning Objective

  • This lesson engages learners with the concept of controlled digital lending on an emergency basis through the HathiTrust Emergency Temporary Access Service.
  • As this requires a baseline knowledge of fair use principles, it should be used as a lesson after students understand fair use.

This episode is appropriate for courses engaging with the topic of fair use and first sale. Students should have a basic understanding of fair use before engaging with this material, though, as it requires a fairly advanced analysis of fair use. As such, it is applicable to many different types of librarianship, including academic librarianship, courses about instruction in librarianship, as well as courses in scholarly communication, archives, and digitization. Controlled digital lending is a relatively advanced concept and students should have a firm understanding of fair use before engaging with this material. This lesson is highly recommended immediately after the lesson on Controlled Digital Lending During COVID-19.

  • After reading the whitepaper, listen to the 19 minute episode on the HathiTrust Emergency Temporary Access Service (ETAS).

During Class

Navigate to the HathiTrust ETAS page about Deactivation or Continuation. Read the “ETAS Continuation Factors” and discuss whether these factors justify controlled digital lending under principles of fair use.

  • Are these factors necessary to justify controlled digital lending, or do they simply strengthen the case for fair use lending?
  • Why might some libraries choose to continue with Controlled Digital Lending even in the absence of these factors (i.e. after the pandemic has ended)?
  • What are the limits, if any, of fair use when applied to justify controlled digital lending?
