Terms of Use – Illinois Experts

1. Overview

The University of Illinois at Urbana-Champaign (the “University”) provides University employed tenure-line faculty as well as other designated researchers and support staff employed by the University, its independent contractors or employees of its independent contractors (“Users,” “You” or “Your”) with access to the Illinois Experts researcher profile portal and system (“Services”), only in order to support the educational, research, and public service missions of the University of Illinois. Support of the University’s missions is accomplished via the inclusion within these Services of the ability to facilitate campus research and collaboration strategies through the aggregation of publicly available publications, patents, and funding data for faculty and researcher Users.  The Services also enable You as a User to further edit and enhance Your profile, including in the uploads posted by You to Your profile.  Others that wish to use these Services may inquire at the Illinois Experts help desk at experts-help@illinois.edu.

The University is providing these Services through a contract with Elsevier B.V. The Services provided and covered by these Terms of Use are those offered through the Elsevier Pure researcher information system. These Services are provided at no cost to Users. Any other services offered by Elsevier are not governed by the contract between Elsevier and the University, nor does the University endorse such services.

As a condition of using the Services provided, You agree to the terms and conditions of usage stated herein (“Terms of Use”). The University reserves the right to change these Terms of Use and/or the nature, functionality or even availability of the Services at any time and at its sole discretion. You are responsible for reviewing these Terms of Use frequently and we urge You to do so. Continuing to use any Services provided under this agreement constitutes Your acceptance and agreement to such changes.

In addition to the terms of use detailed throughout this document Users will be subject to Elsevier’s privacy policy, http://www.elsevier.com/legal/privacy-policy.

Individuals provided with Illinois Experts profiles who decide they wish to discontinue their Illinois Experts accounts should communicate their request in writing by contacting experts-help@illinois.edu.

2. Applicable Laws and Policies

You agree that You are solely and entirely responsible for all content, information, files, or data that You post to Your Illinois Experts profile. You agree not to use the provided Services intentionally or unintentionally to violate any applicable law. You agree that Your use of these Services provided by the University is subject to all the policies and regulations of the University of Illinois and all applicable laws. The University of Illinois has compiled a list of major policy documents that can be found at https://www.uillinois.edu/about/policies (external link). A list of major Information Technology policies can be found at http://go.illinois.edu/itpolicy (external link).

3. Proper and Authorized Use

These Services are intended to support a broad range of research, communications, and information discovery supporting the missions of the University. In addition, Users are expected to act as follows:

Do not divulge Your password or login credentials to any third party. An individual User may designate one or more other Users to serve as a proxy to maintain that individual User’s profile on behalf of that individual User.

Do not upload or enter any confidential, proprietary or regulated University of Illinois or personal data or information, including but not limited to trade secrets, privileged material or software, sensitive personal data, or images or trademarks for which You do not have the rights. Use of accounts to store or transmit copyrighted material such as photographs is forbidden unless permission has been obtained from the copyright owner.

  • Do not remove, obscure or modify in any way any copyright notices, other notices or disclaimers as they appear in the Services.
  • For individual Users who are, or are employed by, independent contractors of University, they may use the Services only for the purposes of the contracted work for University.
  • Do not use the Services to engage in fraudulent activity, misrepresent Your identity or impersonate any person.
  • Comply with all terms and conditions of any third party websites, databases, platforms and other applications and systems as well as any third party intellectual property rights when using the Services, and only use the Services in accordance with such terms and conditions.
  • Do not deliver or otherwise make the Services directly or indirectly available to anyone other than Users.
  • Do not modify, enhance, otherwise change, merge copies of the Services with other software or create derivative works of the Services.
  • Do not use any back-up or disaster recovery copies of the Services (or allow another party to use such copies) for any purpose other than to replace an original copy if it is destroyed or becomes defective or unavailable for use due to a disaster.
  • Do not disassemble, decompile, “unlock,” reverse engineer or in any manner decode the Services for any reason, except as expressly permitted by law without the possibility of contractual waiver, and then only to the extent required to achieve the interoperability of the Services.
  • Do not, unless expressly permitted in the applicable documentation contained in or accompanying the Services or otherwise authorized by University in writing, make any programmatic access to the Services, e.g. via application programming interface (API), except for the purpose of making authorized back-up copies.

4. Privacy, Warranties and Liability

The University is committed to protecting the privacy of its Users. Towards this end, information about our Users and the content of material communicated with or stored within servers owned or controlled by the University of Illinois will be governed by these Terms of Use, including in particular the University’s Web Privacy Notice which may be viewed at https://www.vpaa.uillinois.edu/resources/web_privacy (external link). You should be aware that the information posted to these Services may be visible to all other Users of these Services. While some controls exist that allow You to restrict visibility, the University makes no warranties about the function of these controls and cannot be held liable should these controls fail.

The views and opinions expressed by Users of these Services do not necessarily state or reflect those of the State of Illinois Government or the University of Illinois. Please be aware that we do not control or guarantee the accuracy, relevance, timeliness or completeness of the information expressed by Users of these Services.

The University of Illinois does not assume responsibility, nor can be held accountable, for non-University links or the content or information of those links. This extends to Your use, or losses incurred by Your use, of those links or the information they contain.

The University also does not assume responsibility, nor can it be held accountable, for incompletely or incorrectly aggregating public information for a User, including publications, patents and funding data.  Please note that as a User, You have the ability to edit Your profile or You can request that the University make appropriate corrections.

The University of Illinois may access Your account for administrative and other purposes (such as, but not limited to password resets, compliance with University policies and other rules governing these Services, including the investigation of security incidents) as described in Section 6 of the Campus Policy on Appropriate Use of Computers and Network Systems at the University of Illinois at Urbana-Champaign, which can be found at http://www.cam.illinois.edu/viii/VIII-1.1.htm (external link). This right extends to any information stored within the account. This may require Elsevier to disclose to the University any information stored within the account including email addresses and files of any kind or type. Users of these Services will be notified of account access as described in Section 6 of the Campus Policy on Appropriate Use of Computers and Network Systems at the University of Illinois at Urbana-Champaign.

The University may invoke the above policies to enforce these Terms of Use. The University may at any time suspend or terminate Your account without any cause or notice to You and, in such an event, information may no longer be accessible or may be deleted.

You warrant that the data and information provided by You for the purpose of using the Services, including in the uploads posted by You to Your profile, will not infringe the intellectual property rights or violate any privacy, publicity or other rights of any third parties.

You will indemnify, defend and hold harmless Elsevier B.V. and the University from and against any loss, damage, costs, liability and expenses (including reasonable attorneys’ fees) arising from or out of any third-party action or claim that use of data provided by You for the purpose of using the Services, including in the uploads posted by You to Your profile, infringes or violates the rights of any third party.

If you are dissatisfied with the Services for any reason, or with any of the terms and conditions in these Terms of Use, Your sole and exclusive remedy is to discontinue Your use of these Services and to discontinue Your Illinois Experts account as provided for at the end of Section 1 of these Terms of Use.

5. Administration of the Service and Appropriate Use

While the University of Illinois does not routinely monitor appropriate use by individuals, the University will respond to complaints or other notifications of inappropriate use. Use of these Services is a privilege, not a right, and such use may be suspended or terminated by the University when, in its judgment, these Terms of Use have been violated by the User.

You acknowledge that if Your access to and/or use of the Services is suspended, terminated or otherwise ended, it is possible that You may no longer have access to the data and information in the uploads posted by You to Your profile.
